Ordinance 25646 does not ban walking on sidewalks, carts, or belongings in motion. It only restricts sitting, standing, or lying still within 18 inches of the roadway edge, and only on streets where the speed limit is above 25 mph.
People experiencing homelessness have the right to travel, rest, and carry their belongings. Reporting someone simply for walking with a cart is not a code violation β please do not file a report for this.
Under Ordinance 25646: it is a violation to sit or stand on a median less than 10 feet wide when the posted speed limit is over 25 mph, for longer than is reasonably necessary to cross the road.
On wider medians, or on streets with 25 mph or slower speed limits, sitting is not prohibited by this ordinance. A 2020 Tenth Circuit Court ruling affirmed that people experiencing homelessness have a constitutional right to solicit funds from medians, and cities' ability to restrict this is legally contested.
Ordinance 25646 covers roadway safety, not alleyways. Encampments on private property or blocking alleys may violate other Tulsa codes related to property use, public nuisance, or trespassing β but those are separate from Β§25646.
The appropriate first call is usually Tulsa 311 (918-596-2488). They can dispatch the right department (code enforcement, outreach, or police) based on what you describe. For immediate safety threats, call 911.
All three must be true for a citation under Β§25646:
1. The road has a posted speed limit over 25 mph
2. The person is sitting, standing, or lying still (not just walking)
3. They are within 18 inches of the roadway edge OR on a median less than 10 feet wide
First 90 days after October 18, 2025 is a warning-and-education period β officers issue warnings before fines. Fines are up to $150.
Call 911 only for crime in progress, medical emergencies, or immediate danger.
Call Tulsa 311 (918-596-2488) for code violations, encampments, trash, street issues, or anything not immediately dangerous.
Call Tulsa Police non-emergency (918-596-9222) for suspicious activity, trespassing after-the-fact, or crimes that already happened.
